摘　要：

 实现人与自然和谐共生的中国式现代化蕴含着深刻的环境法治意蕴和深厚的环境法治期许，需要以生态环境法治理念、生态环境政党规范体系、生态环境法律规范体系与生态环境法律实施体系的全面革新作为保障。为完善生态环境法律规范体系，在与其他部门法的关系上，应在整合专门性生态环境法律规范的同时加强环境法与传统部门法的协同；在环境法内部，应确保作为基础的上位环境法律与作为补充的环境行政法规、环境地方性法规和环境规章有机统合。为健全生态环境法律实施体系，在执法上，应强化跨区域联动和跨领域联动，推动环境行政由行政区行政向区域行政、由基于部门的专业化行政向辐射全局的整体性行政迈进；在司法上，应着力建构预防与救济并行的环境司法能动体系，注重不同环境司法制度之间的顺畅衔接与协同增效。

 

On the Environmental Law Guarantee for the Chinese Modernization of Harmony between Human and Nature

Abstract The realization of Chinese modernization of harmony between human and nature contains profound implication and expectation of rule of environmental law, which requires as safeguards the comprehensive renewals in the concept of environmental law, environmental regulation system of the Party, environmental law system, and implementation system of environmental law. In order to improve the environmental legal system, horizontally, the integration of specialized environmental law and regulations should go with strengthened cross-sectoral synergy between environmental law and traditional legal branches; vertically, the organic integration of basic superior laws and complementary environmental administrative regulations, local environmental regulations and environmental rules should be achieved. In order to improve the implementation system of environmental law, the collaboration mechanisms for cross-region and cross-field joint actions on environmental law enforcement should be consolidated, to promote the upgrade of environmental administration from administrative district level to regional administration level, and from department-based specialized administration to overall administration. We should also construct a dynamic environmental justicial system with prevention and relief combined, and ensure the smooth interface and synergies between different environmental judicial systems.
