摘　要：

党的十八大以来，全面依法治国与全面从严治党相互影响。全面从严治党贯彻法治逻辑，在加强党的领导和坚持管党治党方面采取一些法治化措施，形成了法治中国建设的新进路。从实践路径上看，一方面，全面从严治党增强党领导法治建设的权威，影响全面依法治国的深度和广度，从而提升其治理效能，并在推动党的领导制度化、法治化等方面与全面依法治国有共同要求。另一方面，全面从严治党完善党内法规体系，坚持依规治党，实现党内法治，并发挥外溢法治功能。此外，全面从严治党与全面依法治国实现了衔接协调，表现为全面从严治党遵循法治标准，以宪法法律作为依据，在维护政党权威时确立了法制权威。全面从严治党构成法治中国建设的新进路，这是中国特色社会主义法治体系和法治道路的鲜明特征，是习近平法治思想的突出特色和原创性贡献。

 

How the Comprehensive and Strict Governance Of The Party Promotes the Rule of Law in China: The Theoretical Logic and Practical Path

Abstract   The comprehensive and law-based governance of the nation and the comprehensive and   strict governance of the Party have been interacting with each other since the 18th CPC National Congress. The comprehensive and strict governance of the Party implements the logic of the rule of law, takes some legalization measures to strengthen the leadership of the Party and improve the Party's management and self- governance, and thus forms a new path of developing law-based governance in China. On the one hand, the comprehensive and strict governance of the Party enhances the authority of the party's leadership in the construction of the rule of law, and promotes the institutionalization and legalization of the party's leadership, directly affects the depth and breadth of law-based national governance. On the other hand, to comprehensively and strictly govern the Party, it is necessary to improve the system of laws and regulations within the Party, be persistent in governing the party based rules, and realize the legalization of the internal governance of the party. There are also conflicts of the rule of law in the process of comprehensive and strict governance of the party, which requires the management of the party's activities, the implementation of the substantive standard of the rule of law, and the coordination of the authority of the party and the authority of the legal system. The rule of law in China has a political party approach, and the interaction between the comprehensive and strict governance of the Party and law-based national governance is a distinctive feature of China's socialist rule of law, an integral part of the socialist rule of law system with Chinese characteristics and a prominent feature of Xi Jinping thought on the rule of law.
