摘　要：

“滴滴案”与“刘海龙案”的处理结果体现了国家治理新趋势，即民意与法治的融合。舆论与个案的关系不能等同于民意与法治的关系。民意的三重向度体现了从目的价值   向理性价值的质的飞跃，国家治理是一个以目的价值为起点来追求理性价值并回归目的价   值作为检验标准的动态过程。民意与法治融合的理性价值应从实现实质正义、增强国家公信   力和发挥法治建设成果的导向作用三个层面展开。我国应遵循整合舆论、提炼民意、完善法治、反馈社会的逻辑顺序构建舆情联动机制，充分尊重舆论所反映的民意对国家治理的科学价值，保障法治建设体系完整、全面、协调，增强法治自信，同时应权衡这一个案矫正机制的弹性限度。

 

New Trend of National Governance: Integration of the Will of the People and the Rule of Law

On the Cutting Point of the “Didi Case” and “Liu Hailong Case”

Abstract The Didi Case and Liu Hailong Case reflect the new trend of national governance: the integration of the will of the people and the rule of law. The relationship between public opinions and individual cases cannot be equated with the relationship between the will of the people and the rule of law. The triple directions of the will of the people reflect the qualitative leap from the objective value to the rational value. The rational value of the integration of the will of the people and the rule of law from the perspective of national governance should be carried out from three levels, including realizing substantial justice, strengthening national credibility and giving play to the guiding role of the achievements of legal construction. National governance is a dynamic process of pursuing rational value from the starting point of the value of purpose and returning to the value of purpose. To promote the construction of the rule of law, we should pay more attention to improving the legal system, enhancing law enforcement enthusiasm and safeguarding judicial independence, and enhance the confidence of the rule of law. Our country should follow the logical order to build a public opinion linkage mechanism which is from integrating public opinions to refining public opinions to completing the rule of law to reporting back the society. The mechanism should fully respect public opinions on national governance reflecting the scientific value, safeguard the completion, comprehensiveness and balance of the rule of law construction, strengthen the confidence of China’s legislation, and weigh the elastic limit of the mechanism.
