摘　要：

道德能力是人类对于文明和德性生活的认知、追求和向往之能力，是人类直面野蛮、战胜邪恶、不断走向文明和进步的内在力量。司法的公信力取决于司法的道德能力。它内在地包含法官的道德认知和把握能力，道德维护和促进能力以及道德引导和塑造能力。在司法过程中，司法道德能力在个案中往往通过行为的正当化处理、争讼的伦理化转译、诉诸法律的德性条款等方法合乎逻辑地发挥作用。在发生学意义上，这种对司法公信力具有浸润性作用的司法道德能力并非自然的产物，而是教化的成果。故此，在法学教育体系中，当为司法伦理教育留足空间；在社会建设中，应重视社会伦理体系和社会正义的构造，为司法的道德能力成长营造适宜的生态土壤；在国家法治建设中，须恪守立法正义，充盈法治的道德底蕴，为司法的道德能力发挥作用设置平台。

 

On the Moral Ability of the Judiciary

Abstract  Moral ability is the ability of human beings to understand, pursue and yearn for civilization and moral life. It is the inner force of mankind when facing barbarism, defeating evil, and constantly moving toward civilization and progress. The credibility of justice depends on its moral ability, as it inherently contains the judge’s moral cognition and ability to grasp, maintain and promote, and guide and shape. In the judicial process, judicial moral competence often plays a logical role in cases through the justification of acts, the ethical translation of disputes, and the virtue clause of resorting to law. In the sense of genetics, this kind of judicial moral ability, which has an infiltrating effect on judicial credibility, is not a natural product, but a result of enlightenment. Therefore, in the legal education system, we should leave enough space for judicial ethics education; in the social construction, we should attach importance to the construction of social ethics system and social justice, and create an appropriate ecological environment for the growth of judicial moral ability; in the construction of national rule of law, we should abide by legislative justice, enrich the moral content of the rule of law, and establish a platform for the role of judicial moral ability.
