摘　要：

我国从1978年开始启动改革开放，法制建设也随之提上议事日程，刑法是最早颁布的七部法律之一。随着刑法颁布，外国刑法学也开始恢复重建，刑法学经历了一个从以立法论为中心到以司法论为中心的演进过程。从1978年算起，到2018年正好过去了40年，在这期间我国刑法学在不断回应立法与司法的过程中，获得了长足的进步。尤其是刑法教义学逐渐生长，成为我国刑法知识的主体内容。我国刑法学应当以教义学作为基本走向，并且吸收刑事政策的内容，使我国刑法学保持对社会的即时反应能力。

Forty Years of Research on Chinese Criminal Law（1978-2018）

Abstract:Since the launch of the reform and opening-up policy in 1978,the legal construction has been putting on the agenda.Criminal Law is one of the first seven laws.With the enactment of the Criminal Law,foreign criminal law has also begun to be reconstruct.The evolution of Criminal Law has changed from focusing on legislation to focusing on the theory of justice.It has been forty years since 1978 and there are continuous progresses in the construction of Criminal Law through its responses to legislation and justice.Most of all,as the blossom of strafrechtsdogmatik,it has become the main body of the knowledge of criminal law.The Chinese Criminal Law should regard dogmatic as the basic trend and absorb the content of criminal policy.Only in this way can the Chinese Criminal Law maintain the immediate reaction capacity to the social changes.
