摘　要：

监察委员会的调查权具备国家性、强制性、综合性等特征，其与侦查权的权力内涵及外延具有一定差异性，但也有不少相似之处。《监察法（草案）》中勾勒出调查权运行程序，并明确证据收集、运用应与审判标准一致。但仍有待明确之处：监察委员会调查程序应结合反腐调查的特殊性，确立调查权行使的权力法定、程序规范、比例原则，厘清监察委员会与检察院、法院分工负责、相互制约的权力关系，将调查权纳入法治化轨道，保障调查权在实践中的合法、有效展开。

Investigation Power of the Supervision Committee:Considerations of Its Nature,Execution and Regulation

Abstract:The investigation power of the Supervision Committee has the characteristics of stateness,coercion and uniqueness,which is different from the detection power in terms of connotation and extension to some extent.However,they have some similarities. The “Supervision Law(Draft)” outlines the procedural framework for the investigation power operation and clarifies that the evidence should be collected and used in accordance with the standards of trial. However, there are some contents of the draft remain to be clarified: The investigation procedure of the Supervision Committee should combine with the particularity of anti-corruption investigation,establish the execution of investigation power according to the principles of power prescribed by law,due process and proportionality,clarify the power relations called division of labor responsibilities and restraint of each other among the Supervision Committee,procuraorate and court, and bring the investigation power in the channel of rule of law,in order to protect effective and legal implementation of investigation power in practice.
